  • If you are a parent or grandparent of a child with a disability. Whether you have a child that was born with a disability or has become disabled as a result of an accident, it is important to develop a comprehensive special needs plan. If the child is eighteen or older, a guardianship may be necessary. Also, it is key that your estate plan takes into consideration the public benefits available to your child and is carefully crafted so as not disqualify them from those benefits. If assets are inherited directly by a child who is receiving public benefits, they run the risk of losing those benefits.
