Mediation is a process designed to resolve disputes with the help of a third party facilitator, called the mediator. The mediator does not replace your attorney but rather works with all parties to guide the process and to help you determine a reasonable solution - one that makes sense to the individuals involved versus resolutions that are imposed from the outside, such as a judge. OWM Law offers mediation for the entire spectrum of family disputes. In many cases, divorcing couples mediate custody, distribution of assets, alimony, child support and other issues. Parents who were formally married or never married use mediation to address custody issues. Same sex couples use mediation to address a myriad of issues that arise in resolving or dissolving their relationship.  Mediation is much less confrontational than traditional litigated divorce and successful mediation facilitates decision-making helping the parties develop creative solutions and hopefully bringing cases to a speedier, less costly and more amicable conclusion.

Understanding the Mediation Process

  • Mediation provides an opportunity to speak and to be heard in a safe and neutral environment.
  • Mediation empowers disputing parties to explore their differences and to make choices.
  • Mediation is voluntary and gives the parties the opportunity to define their disputes.
  • Mediation opens the door to understanding. From that understanding may come resolution.
  • Mediation is endorsed by the Supreme Court of Pennsylvania and the Courts of many counties as a viable alternative to the courtroom.

Divorce Done Right

OWM Law strongly supports the mediation process and has had great success with our clients over the years. Finding the right mediator is important.

David Kaplan serves as a Court appointed custody mediator and a community mediator with the Pottstown Human Relations Commission. He along with other prominent divorce attorneys and trained mediators are part of DivorceDoneRight, Inc. Their goal is to help divorcing couples, unmarried parents and other fractured relationships to navigate their way through the painful chaotic minefield of decision-making.

David also chaired the Montgomery County Family Law Mediation Committee, and is a founding member of the Elder Mediation Committee of the Montgomery Conflict Mediation Center. Mr. Kaplan is a member of the Pennsylvania Council of Mediators.
